Agreement Scope

These Terms & Conditions govern your use of vehicle arrangement services provided by Claret Axis, operating in Montreal, Quebec, and surrounding regions. By engaging our services, you accept these terms in their entirety.

Definitions

  • "Services" refers to vehicle arrangements including Studio Day Rental, Atelier Week Arrangement, and Guided Experience Service
  • "Client" means any individual or entity engaging our services
  • "Vehicle" includes all automobiles in our collection made available through arrangements
  • "Arrangement" means the booking contract between Client and Claret Axis
  • "We," "Us," "Our" refers to Claret Axis and its authorized representatives

Eligibility Requirements

To access our services, clients must meet the following criteria:

  • Minimum age of 25 years
  • Valid driver's license issued within the past 10 years (for self-driven arrangements)
  • Clean driving record (major violations may result in service denial)
  • Valid government-issued identification
  • Proof of insurance coverage or acceptance of our insurance provisions
  • Valid payment method

International clients must present passport and valid driver's license from their country of residence, along with International Driving Permit when required by Quebec regulations.

Booking and Confirmation

Arrangements proceed through the following process:

  1. Initial consultation to discuss requirements and vehicle selection
  2. Availability confirmation and pricing discussion
  3. Formal booking request with required documentation
  4. Verification of eligibility and insurance provisions
  5. Deposit payment (typically 30-50% of total arrangement fee)
  6. Written confirmation with arrangement details

Bookings are considered confirmed only upon receipt of deposit payment and written confirmation from our team. Availability is subject to change until formal confirmation.

Payment Terms

Currency: All prices are quoted in Canadian Dollars (CAD).

Payment Schedule:

  • Deposit due at booking confirmation
  • Remaining balance due 48 hours before arrangement begins
  • Additional charges for damages, violations, or extended use due upon arrangement completion

Accepted Payment Methods: Credit cards (Visa, Mastercard, American Express), bank transfers, and certified checks.

Security Deposit: A refundable security deposit may be required, typically CAD $1,000-$5,000 depending on vehicle category. This is released 7-10 business days following arrangement completion, subject to vehicle condition verification.

Taxes: All prices are subject to applicable Quebec and Canadian federal taxes.

Cancellation and Refund Policy

Cancellation terms vary based on notice period:

  • 30+ days before arrangement: Full refund minus 10% administrative fee
  • 14-29 days before: 50% refund
  • 7-13 days before: 25% refund
  • Less than 7 days: No refund

Refunds are processed within 14 business days to the original payment method. Force majeure circumstances may warrant exceptions at our discretion.

Vehicle Use and Restrictions

Permitted Use:

  • Personal transportation within agreed geographic areas
  • Professional business use as discussed during booking
  • Cultural and recreational activities

Prohibited Activities:

  • Commercial transportation services (taxi, rideshare, delivery)
  • Racing, timed events, or performance testing
  • Off-road driving or unpaved surfaces
  • Towing or pushing other vehicles
  • Transporting hazardous materials
  • Use by anyone other than authorized driver(s)
  • Illegal activities of any nature
  • Smoking or vaping inside vehicles

Violation of use restrictions may result in immediate arrangement termination, forfeiture of all fees, and liability for damages.

Client Responsibilities

  • Maintain vehicle in good condition throughout arrangement
  • Report any mechanical issues or damage immediately
  • Comply with all traffic laws and parking regulations
  • Pay for fuel (vehicles are provided with full tank and should be returned full)
  • Pay for any traffic violations or parking fines incurred
  • Return vehicle at agreed time and location
  • Maintain cleanliness appropriate to luxury vehicle standards

Insurance and Liability

All arrangements include comprehensive insurance coverage through specialized providers. This coverage includes:

  • Third-party liability as required by Quebec law
  • Collision damage coverage with deductible
  • Theft protection

Client Liability: Clients are responsible for:

  • Insurance deductible amounts (typically CAD $2,500-$10,000 depending on vehicle)
  • Damages resulting from prohibited use or negligence
  • Interior damage from smoking, staining, or excessive wear
  • Lost keys or remote devices

Additional insurance options may be available at booking to reduce deductible amounts.

Accidents and Damage Protocol

In the event of an accident or damage:

  1. Ensure safety of all parties involved
  2. Contact emergency services if needed (911)
  3. Notify Claret Axis immediately (+1 514-739-2856)
  4. Do not admit fault or make statements to other parties
  5. Document scene with photos if safe to do so
  6. Obtain contact information from all parties and witnesses
  7. File police report when required by law or when other party is uncooperative
  8. Complete our incident report form within 24 hours

Failure to follow proper accident protocol may affect insurance coverage and increase client liability.

Disclaimers and Limitations

Services are provided "as is" with the following understandings:

  • We maintain vehicles to high standards but cannot guarantee freedom from mechanical issues
  • Vehicle characteristics and performance vary; client assumes risk of unfamiliarity
  • We are not liable for indirect damages including lost time, missed opportunities, or consequential losses
  • Maximum liability is limited to arrangement fees paid
  • We reserve right to substitute vehicles of comparable quality if necessary
  • Weather conditions and road situations are client responsibility

Termination Rights

We reserve the right to terminate arrangements immediately without refund if:

  • Client violates use restrictions
  • Vehicle is used for illegal activities
  • Driver appears impaired or unsafe
  • Documentation provided proves false or misleading
  • Payment methods fail or are disputed
  • Client endangers vehicle or violates terms

Upon termination, client must return vehicle immediately to our location or designated point.

Intellectual Property

All content on our website, promotional materials, and communications—including text, graphics, logos, and design elements—is the property of Claret Axis and protected by Canadian copyright law. Use without express permission is prohibited. Vehicle manufacturers retain all rights to their respective trademarks and design elements.

Dispute Resolution

In the event of disputes:

  1. Parties agree to attempt informal resolution through good-faith discussion
  2. If resolution proves unsuccessful, mediation may be pursued
  3. Disputes not resolved through mediation will be subject to binding arbitration in Montreal, Quebec
  4. Quebec law governs these terms and any disputes arising from them

Legal proceedings must be initiated within one year of the incident giving rise to the claim.

General Provisions

Entire Agreement: These terms, together with any written arrangement confirmation, constitute the complete agreement between parties.

Severability: If any provision is found unenforceable, remaining provisions continue in full force.

No Waiver: Failure to enforce any term does not constitute waiver of that or other terms.

Assignment: Clients may not transfer their arrangements to others without our written consent.

Amendments: We may update these terms with notice to active clients. Continued use constitutes acceptance of modifications.
